These Terms of Service ("Terms") govern your use of energyunleashed.com.au and energyunleashed.co.nz (together, the "Site") and your purchase of products from Energy Unleashed ("we", "us", "our"). By using the Site or placing an order you agree to these Terms.

1. Our Products

1.1 We sell caffeine pouch products. Our products contain caffeine and are intended for healthy adults.

1.2 Our products are not recommended for: people under 18, pregnant or breastfeeding women, people sensitive to caffeine, or people with heart conditions or other medical conditions affected by caffeine. Follow the usage guidance on the packaging, do not exceed the recommended serving, and keep out of reach of children.

1.3 By ordering you confirm you are at least 18 years of age.

1.4 Information on the Site is general information only and is not medical advice. If you have any concerns about caffeine consumption, talk to a health professional before using our products.

2. Orders and Payment

2.1 Prices are shown in Australian dollars for customers in Australia and in New Zealand dollars for customers in New Zealand, and include GST where applicable. Prices and products may change at any time before you place an order.

2.2 Your order is an offer to buy. We may decline or cancel an order (with a full refund) where a product is unavailable, where there is an obvious pricing or listing error, or where we reasonably suspect fraud or resale abuse.

2.3 If part of your order is unavailable after you order, we will contact you to offer a substitute, a partial refund, or a full refund.

3. Subscriptions

3.1 Where you purchase a subscription, you authorise us to charge your nominated payment method at the frequency shown at checkout until you cancel.

3.2 You can cancel, pause or change a subscription at any time via the link in your subscription emails or by contacting sales@energyunleashed.com.au. Cancellations take effect from the next billing date; charges already processed are fulfilled as normal.

3.3 If a subscription renewal cannot be fulfilled (for example a payment failure or stock issue), we will contact you rather than silently skipping or substituting.

4. Shipping, Returns and Refunds

4.1 Shipping is governed by our Shipping & Delivery Policy, and returns by our Returns & Refunds Policy, both published on the Site and forming part of these Terms. Nothing in any policy excludes your rights under the Australian Consumer Law or, for New Zealand consumers, the Consumer Guarantees Act 1993.

5. Promotions, Discounts and Gift Cards

5.1 Discount codes and promotions apply only as described at the time of the offer, cannot be exchanged for cash, and may not combine with other offers unless stated.

5.2 Gift cards are valid for at least 3 years from issue and are not redeemable for cash except where required by law.

6. Intellectual Property

6.1 All content on the Site, including our name, logos, product names, images and copy, is owned by or licensed to us and may not be used without our written permission.

7. Liability

7.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, the New Zealand Fair Trading Act 1986, or any other law that cannot lawfully be excluded.

7.2 To the extent permitted by law, and other than as set out in these Terms and the consumer laws that apply to you, we exclude liability for indirect or consequential loss arising from your use of the Site or our products, and our total liability in connection with any order is limited to resupplying the products in that order or refunding the amount you paid for it.

7.3 We are not liable for delay or failure caused by events beyond our reasonable control, including carrier delays, customs processing, industrial action or natural events; where such an event materially affects your order, our Shipping and Returns policies set out your remedies.

8. General

8.1 These Terms are governed by the laws of South Australia, Australia, and you submit to the non-exclusive jurisdiction of its courts. If you are a consumer in New Zealand, this does not deprive you of the protection of consumer laws that apply to you regardless of the governing law.

8.2 If any part of these Terms is found invalid, the rest continue in force. We may update these Terms from time to time; the version published on the Site at the time you place an order applies to that order.
